It generated a staggering $250 million in retail sales within its first year.

The brand’s rapid ascent was further boosted by strategic partnerships with prominent sports organizations. This includes Arsenal Football Club, UFC, and various professional teams. With bold flavors and promises of replenishing electrolytes, Prime positioned itself as the ultimate refreshment.

The Prime Drink Lawsuit: A Bitter Aftertaste

Amidst the brand’s soaring popularity, a dark cloud loomed over Prime Hydration’s grape-flavored offering. Independent third-party testing revealed the presence of per- and polyfluoroalkyl substances (PFAS), commonly referred to as “forever chemicals,” in this particular flavor. These man-made chemicals have been extensively studied and linked to a range of adverse health effects, including reproductive harm, developmental delays, increased cancer risk, and interference with hormonal functions.

In August 2023, a class-action lawsuit was filed against Prime Hydration by the Milberg law firm on behalf of lead plaintiff Elizabeth Castillo and others similarly affected. The suit alleges that Prime Hydration engaged in deceptive marketing practices by promoting the product as a healthy beverage while failing to disclose the presence of PFAS.

According to the complaint, Castillo, a California resident, purchased Prime Hydration on multiple occasions but states that she would not have done so had the product been accurately labeled as containing these potentially harmful chemicals. The lawsuit seeks damages, injunctive relief, and other remedies for consumers nationwide and within California.

Logan Paul’s Response

In a TikTok video released on April 24, Logan Paul addressed the PFAS allegations head-on. He asserted that the lawsuit’s claims were unfounded, saying, “First off, anyone can sue anyone at any time; that does not make the lawsuit true. And in this case, it is not.” Paul further explained that the alleged PFAS presence stemmed from the plastic bottles used for packaging rather than the drink itself.

Paul said that Prime Hydration utilizes top-tier bottle manufacturers in the United States, implying that the company adheres to industry standards and regulations.

However, the court has yet to issue a written order on the motion to dismiss the lawsuit, leaving the matter unresolved for the time being.

The Caffeine Problem

Another point of issue surrounding Prime Hydration revolves around its caffeine content. In April 2023, a class-action lawsuit was filed in the Southern District of New York. The lawsuit alleged that Prime Hydration’s 12-ounce energy drinks contained between 215 and 225 milligrams of caffeine.

The suit, filed by Lara Vera, a Poughkeepsie, New York resident, seeks $5 million in damages from Prime Hydration LLC. It cites misleading and deceptive practices. Vera claims that she would not have purchased the drinks had she been aware of the actual caffeine content. She argued that the content is excessive, particularly for children and adolescents.

Compounding these concerns, U.S. Senate Majority Leader Chuck Schumer called on the Food and Drug Administration to investigate Prime Hydration’s energy drinks in 2023. Schumer alleged that the brand’s vague marketing tactics, targeting young audiences, influenced parents to unknowingly purchase a “cauldron of caffeine” for their children.

The Bottling Dispute

In addition to the PFAS and caffeine controversies, Prime Hydration found itself embroiled in another legal battle with beverage bottler Refresco Beverages US Inc. In August 2024, Refresco filed a $68 million lawsuit against Prime Hydration and an affiliate, alleging breach of contract.

According to the lawsuit, Refresco and Prime Hydration had entered into a preliminary agreement. The agreement required the bottler to invest significant resources in customizing its production line to meet the brand’s specifications. It allegedly included a minimum volume commitment and a “take or pay” provision. This obligated Prime Hydration to pay a fixed fee per case in the event of an order shortfall.

However, as Prime Hydration’s demand began to wane, the company allegedly sought to back out of its commitments, offering what Refresco claims were “phony excuses.”

The lawsuit seeks to recover the unrecouped costs incurred by Refresco and the profits it would have earned had the agreement been honored.

The Aftermath of the Prime Drink Lawsuit

Prime Hydration’s initial success on social media fueled the brand’s fortunes, but those fortunes appear to have taken a turn. According to the lawsuit, the fading social media buzz that powered its rapid rise attributed to the sales decline.

Yahoo echoed this sentiment in a separate report. It cited Nielsen data that revealed a 50% year-over-year decline in Prime Hydration’s sales in the UK.

The Future of Prime Hydration

Prime Hydration has faced a turbulent ride, with legal battles and public scrutiny casting a long shadow over the brand. Regaining consumer trust and maintaining its market position will be no easy feat.

The company must directly address the serious allegations leveled against it, including those related to PFAS and caffeine content. Only then can it hope to rebuild confidence among consumers and partners.

Beyond these immediate challenges, Prime Hydration would be wise to rethink its marketing approach.
